Sales Commission Agreement

_______________________ (hereafter “Employer”) and _______________________ (hereafter “Employee”) hereby agree to the following:

Beginning {date}, the Employee will receive base pay of {amount} as well as a commission of {amount/percentage/bonus} for sales made of {product/service}.

The Employee will receive commission payments {frequency} based on the following practices and requirements:

• The Employee must log and report all sales via {method} by {date} each {time period}.
• Commission payments will be made upon {sale date/client payment/pay period/etc.}.
• The Employee is subject to sales quotas as follows: {sales quotas}.
• The Employee must sell exclusively for {Company Name} for the duration of this Agreement.
• The Employee agrees not to work for a competing business or start a related business for a period of {time} after leaving {Company Name}.
• The Employee agrees to protect the confidential and intellectual property of Employer, including but not limited to: {client lists, sales methods, pricing tiers, etc.}.

If the Employee quits, commissions will be paid out as follows: {details}. If the Employee is terminated for cause, commissions will be paid out as follows: {details}. If the Employee is subject to layoff, commissions will be paid out as follows: {details}.
