Pet Custody Agreement

_____________________________ (hereafter "Pet Owner 1") and _______________________ (hereafter "Pet Owner 2") hereby agree to the following:

As the two parties are no longer {married, partnered, cohabitating}, custody of {Pet Name(s), ages, breeds} (hereafter "Pets") will be as follows:

Pet Owner 1 will have {sole/primary} custody of {specific pets}. {He/she} will maintain all legal rights of ownership over the pets and will determine their feeding, exercise and medical plans. {He/she} will pay for all identification, check-ups, procedures and medications. {He/she} shall be responsible for daily feeding, care and waste cleanup of the pets. Party 2 shall have the right to visit the pets at {location} every {day(s) of the week} at {times} and to host the pets {alone/under supervision} at {location(s)} every {day(s) of the week} at {times}.

Pet Owner 2 will have {sole/primary} custody of {specific pets}. {He/she} will maintain all legal rights of ownership over the pets and will determine their feeding, exercise, and medical plans. {He/she} will pay for all identification, check-ups, procedures and medications. {He/she} shall be responsible for daily feeding, care and waste cleanup of the pets. Party 1 shall have the right to visit the pets at {location} every {day(s) of the week} at {times} and to host the pets {alone/under supervision} at {location(s)} every {day(s) of the week} at {times}.

Both parties agree to adhere to the visitation schedules outlined above and to make all good faith attempts to reschedule when necessary for either party. Both parties will provide advance notice if the schedule needs to be altered for any reason.

Both parties agree to provide proper affection and care for the Pets at all times they are in the party's custody. This includes adequate access to fresh food and water, fresh air, exercise, shelter and medical care. The parties will not in any way neglect or abuse the Pets.

Both parties agree to make the other party the first choice for pet-sitting, and both parties retain the option to decline an opportunity to pet-sit outside of normal visitation.

If either party feels they can no longer provide adequate care for the Pets, they both agree that the other party shall have first consideration for adopting the Pets and taking sole ownership.

Both parties agree to indemnify and hold each other harmless in the event that the pet(s) are lost or stolen, run away, or are injured or killed, except in cases of willful neglect or abuse.
