Non-Disparagement Agreement for Divorce

{Party 1} and {Party 2} hereby agree to the following terms in the case of the dissolution of their marriage, dated {date}.

• Both parties agree not to disparage the other party in written or oral remarks to or in the presence of {their children, associated parties, coworkers, employers, media, the press, anyone, etc.}.
• Parties agree that "disparaging remarks" include, but are not limited to, negative statements, criticisms, critiques, insults, or defamatory phrases. Both parties understand that the truthfulness of the remark is inconsequential in this agreement.
• Parties agree that "disparaging remarks" include any of the aforementioned statements spoken, written, or dictated in person, on social media platforms, or by proxy.
• Either party found participating in disparaging remarks against the other party will be fined {amount} per remark.
• Should either party be taken to court over the issue of disparaging remarks, the losing party agrees to pay the winner's legal fees.
